Website, Services and Online Store Terms and Conditions

These Terms and Conditions apply to the UFuel website at www.ufuel.co.za, its online shop, enquiry and enrolment forms, linked client-access systems, digital resources and the goods and services offered by U Fuel (Pty) Ltd. By using the website, submitting information, enrolling in training or placing an order, you agree to these terms to the extent applicable to that activity.
1. About UFuel and acceptance
1.1 U Fuel (Pty) Ltd, registration number 2018/071546/07, is a South African petroleum consultancy, training and product business referred to in these terms as “UFuel”, “U Fuel”, “we”, “us” or “our”.
1.2 These terms must be read with any written proposal, engagement letter, invoice, product description, Academy enrolment form and the UFuel Privacy and POPIA Policy. A project-specific written agreement will govern the professional engagement to which it relates.
1.3 If you do not agree to these terms, you must not use the website, submit an order or access protected UFuel material.
2. Important consumer notice
2.1 These terms may apply to consumers under the Consumer Protection Act 68 of 2008 and to electronic transactions under the Electronic Communications and Transactions Act 25 of 2002.
2.2 Certain clauses limit risk or liability, allocate responsibility, require an acknowledgement or explain circumstances in which an order or engagement may be refused, suspended or cancelled. Nothing in these terms is intended to exclude a right or remedy that cannot lawfully be excluded.
2.3 Ask UFuel to explain any term you do not understand before purchasing a product, enrolling in training or accepting a professional proposal.
3. Refunds
3.1 This policy applies to the return of goods and/or services, bought from us, U Fuel (Pty) Ltd (“U Fuel”) by you (“the consumer”).
3.2 U Fuel does not provide refunds unless in accordance with the applicable legal provisions and/or instead offers the consumer with credit on his/her account to be used on any future service requirements as provided for by U Fuel. U Fuel reserves the right to determine the value of such credit.
3.3 All refunds are subject to internal Anti-money laundering protocols.
3.4 All refunds may be subject to incidental costs (e.g. bank charges etc), which will be withheld from the refund amount.
3.5 U Fuel licensing services, and prior to giving client access to our online system, and any documentation (our intellectual property) being provided, 50% of the invoice is payable. This is non-refundable should the applicant decide not to proceed with the application.
3.6 U Fuel Online training programmes, U Fuel (Pty) Ltd offer a 7-day Money Back Guarantee on the training programmes, calculated from the day the learner is granted access to our training website/portal. Access will be confirmed via an email with the learners login details. After the 7-day period no refund or cancellation will be available.
3.7 You must ensure that you present your original tax invoice or other proof of purchase when returning services and/or goods.
3.8 Where the services and/or goods in question are not defective or where you do not have a statutory right to return goods, U Fuel may, in its sole and absolute discretion, elect to accept returns and replace the services and/or goods in question or refund the consumer. Where U Fuel does so, this is done so in good faith. It is not an admission of liability, nor should it be taken as an acknowledgement that the U Fuel will accept similar returns on the same basis in the future.
3.9 U Fuel is only bound to accept the return of services and/or goods when it is required to do so in terms of the relevant law, including in terms of the Consumer Protection Act 68 of 2008.
3.10 In any other case, U Fuel
3.10.1 does so in its sole and absolute discretion in each instance; and
3.10.2 may, in its sole and absolute discretion, elect whether to replace the services and/or goods or refund the consumer.
3.10.3 Collection or acceptance of refunded/returned services and/or goods by U Fuel, even where the consumer believes it has a statutory right to return goods, does not constitute acceptance of liability by the U Fuel.
3.11 Returns for goods and/or services purchased as a result of direct marketing
3.11.1 U Fuel will accept returns of services and/or goods purchased as a result of direct marketing by U Fuel, provided that you notify the U Fuel of your intention to return the services and/or goods within 5 business days after the services and/or goods were delivered to you and you return the services and/or goods, at your risk and expense, to us within 10 business days from the date on which the goods were delivered to you.
3.12 U Fuel will accept returns:
3.12.1 where you were not given a reasonable opportunity to examine or inspect goods and/or services prior to delivery and you reject the goods and/or services on the basis that they are not of the type or quality reasonably contemplated or do not conform with the agreed specifications in the case of custom-made or special-order goods;
3.12.2 where goods and/or services that you ordered have been mixed with goods and/or services that you did not order (and in this case you may return all of the goods or only those that differ from what you ordered);
3.12.3 where the goods and/or services ordered are not suitable for their intended specified purpose (provided that the specified purpose was communicated to us and we agreed to supply the goods and/or services on that basis); and
3.12.4 provided that in all cases the goods are returned to us within 10 business days after delivery.
3.13 In all instances relating to the return of goods and/or services, U Fuel may impose a reasonable charge where:
3.13.1 the goods and/or services, are not in their original condition – i.e. damaged packaging, partially consumed and/or that are not in a saleable condition;
3.13.2 the goods and/or services, returned in boxes or packaging that have been re-marked, damaged or defaced in any way, including price stickers; or
3.13.3 documentation was received, or work started on a specific service;
3.13.4 the goods and/or services, have been depleted or consumed in excess of the amount reasonably necessary to determine that the goods were unacceptable.
3.14 Notwithstanding the provisions above, no returns will be accepted if:
3.14.1 the return is prohibited for public health reasons;
3.14.2 where the consumer had a change of heart;
3.14.3 the product and/or service was specifically create for the consumer;
3.14.4 any other public regulation prohibits the return of the goods for whatever reason;
3.14.5 the goods and/or services, have been altered contrary to U Fuel’ or the manufacturer’s instructions after leaving our control
3.14.6 the goods and/or services, have been partially or entirely disassembled; or
3.14.7 he goods and/or services, have been permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, other goods
4. Notwithstanding the above, kindly note that all refunds will be processed within 30 days from receiving the required documentation from the Client.
5. Website use and accounts
5.1 You may browse the website and, where enabled, place an order as a guest. Account registration is optional unless a particular service or protected system requires an account.
5.2 You must provide accurate information and keep account credentials confidential. You are responsible for activity conducted through your account until you notify UFuel of suspected unauthorised access.
5.3 You may not interfere with the website, introduce malicious code, attempt unauthorised access, scrape protected material, impersonate another person or use the website for an unlawful purpose.
6. Professional petroleum services
6.1 Website content and an initial enquiry do not create a professional engagement. Work begins only after UFuel issues a written scope or proposal and the applicable terms, client-information requirements and payment arrangements are accepted.
6.2 You must provide complete, accurate and timely information and promptly disclose material changes. UFuel may pause work where information, documents, instructions, access or payment remain outstanding.
6.3 Regulatory authorities, financiers, laboratories, suppliers, landlords, sellers, buyers and other independent parties make decisions within their own mandates. UFuel does not guarantee a licence, approval, finance, supply account, tender award, transaction, valuation outcome or commercial result.
6.4 Estimated timeframes depend on client inputs and third-party processes. Unless expressly agreed in writing, a stated timeframe is an estimate rather than a guaranteed completion date.
7. UFuel Academy
7.1 Current enrolment availability is confirmed before payment. Enrolment is accepted when UFuel confirms the learner’s place and issues written acceptance, an invoice or access instructions.
7.2 Academy access is personal to the enrolled learner. Login details, videos, documents, quizzes, directories and other learning material may not be shared, copied, recorded, resold or distributed without written permission.
7.3 A certificate of completion records completion of the applicable UFuel programme. Training improves knowledge and readiness but does not guarantee a regulatory, financing or commercial outcome.
8. Online shop orders, stock, pricing and payment
8.1 Products, specifications, prices and delivery charges are displayed in South African rand. VAT will only be charged where UFuel is legally registered and required to charge it, and any VAT amount will be shown on the applicable invoice or checkout.
8.2 An online order is an offer to purchase. UFuel may accept or reject an order based on product availability, pricing accuracy, payment authorisation, delivery feasibility, suspected fraud or another reasonable commercial ground.
8.3 Receipt of an automated order or payment message does not by itself confirm dispatch. UFuel will contact you if a product becomes unavailable or if information is required to complete the order.
8.4 Online card and supported electronic payments are processed by an external payment service provider. UFuel does not intentionally store complete card details on its website.
9. Delivery
9.1 Physical-product delivery is currently limited to addresses in South Africa unless UFuel agrees otherwise in writing. The applicable delivery charge is displayed at checkout or on the invoice.
9.2 You must provide a complete and accessible delivery address and ensure that an authorised person can receive the parcel. Delivery is complete when the parcel is delivered to the nominated address or accepted by the nominated recipient.
9.3 Inspect the parcel promptly and notify UFuel at hello@ufuel.co.za of visible damage, missing items or an incorrect product, with supporting photographs where reasonably possible.
10. Product use and fuel-testing limitations
10.1 Product instructions and safety precautions must be followed. Fuel-testing kits and field indicators support practical screening and operational decisions; they do not replace accredited laboratory analysis, statutory sampling or a competent authority’s determination where those are required.
10.2 UFuel is not responsible for results affected by incorrect sampling, contamination, unsuitable conditions, damaged equipment, unauthorised modification, incorrect interpretation or use outside the stated purpose.
11. Privacy and personal information
11.1 UFuel processes personal information for enquiries, professional engagements, Academy enrolment, orders, delivery, payment administration, legal compliance, security and related business purposes as described in the Privacy and POPIA Policy.
11.2 You confirm that you are authorised to provide any personal information submitted on behalf of another person, company, applicant, learner, customer or transaction party.
12. Intellectual property
12.1 The website, UFuel branding, course material, templates, methodologies, reports, databases, illustrations, videos, product documentation and other content are owned by or licensed to UFuel and are protected by applicable intellectual-property law.
12.2 No right of ownership is transferred to you. You may use delivered material only for the purpose and within the licence stated in the applicable engagement, enrolment or product documentation.
13. Website availability, third-party links and external systems
13.1 UFuel may maintain, suspend, change or discontinue website features. We do not guarantee uninterrupted availability and may temporarily restrict access for maintenance, security or operational reasons.
13.2 Links to government websites, payment services, couriers, client systems, training platforms and other third-party resources are provided for convenience. Those parties operate under their own terms and privacy policies.
14. Accuracy, disclaimers and limitation of liability
14.1 UFuel takes reasonable steps to maintain accurate information, but legislation, regulations, official practices, pricing and commercial conditions may change. Website information is general and must be confirmed for the specific project or transaction.
14.2 To the maximum extent permitted by law, UFuel is not liable for indirect, special or consequential loss arising solely from website use, reliance on general website information, third-party systems or circumstances outside UFuel’s reasonable control.
14.3 Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence or another liability that cannot lawfully be excluded or limited.
15. Electronic communications and marketing
15.1 You consent to receiving operational electronic communications required to respond to an enquiry, administer an engagement, provide Academy access, process an order, deliver a product or address a security or legal matter.
15.2 Marketing communications will be sent where permitted by law and may be declined or unsubscribed from without affecting an existing order or engagement.
16. Changes, governing law and disputes
16.1 UFuel may update these terms. The version published when you place an order or accept an engagement applies to that transaction, subject to any later written agreement.
16.2 These terms are governed by the laws of the Republic of South Africa. Nothing prevents a consumer from approaching a court, tribunal, regulator or other forum that has lawful jurisdiction.
